JOHOR BARU - A man and his girlfriend were sentenced to death by the High Court here after they were found guilty for the murder of his three-year-old son four years ago.

Justice Collin Lawrence Sequerah meted out the sentence on Mohd Imran Mohd Ramly, 34 and Norhidayah Mamid, 30, after the prosecution successfully proved its case.

Norhidayah, who is engaged to another man, was seen crying and sobbing after the sentence was handed down by the judge.

According to the charge sheet, the duo were charged with murdering Muhammad Aqeef Adam Mohd Imran at an apartment in Bandar Putra, Kulai between midnight on Dec 16 and 6.45pm on Dec 19, 2013.

They were charged under Section 302 of the Penal Code, which carries the mandatory death sentence upon conviction.

Sequerah made the judgement after ruling that the defence failed to prove the case beyond reasonable doubt.

He said this was not a straight forward case, adding that although no witnesses saw the actual crime committed by both accused, the sentence was made based on circumstantial evidence.

"Following the post-mortem result, the deceased showed consistent bruises, multiple injuries all over his body and blunt force trauma that resulted in his death," he added.

Deputy public prosecutor Nor Iffa Zarilla Abd Rahman appeared for the prosecution while lawyers Shahruddin Osman and Normah Mohd Desa acted for Norhidayah and Mohd Imran respectively.

Man, girlfriend sentenced to death for son's murder three years ago


JOHOR BARU: A 34-year old company manager and his girlfriend were sentenced to death by the Johor Baru High Court today for the murder of his three-year-old son three years ago.

Mohd Imran Mohd Ramly and Norhidayah Mamid, 31, were found guilty for the murder of Muhammad Aqeef Adam Mohd Imran at an apartment in 2013, in a case which had elements of abuse.

Judicial Commissioner Collin Lawrence Sequerah said he found that the defence team had failed to raise any reasonable doubt against Imran and Norhidayah's abusive acts that led to the child's death.

"I find there was common intention from both the accused to inflict the injuries to the victim.

"Based on these evidence from witnesses, I find both the accused guilty of the offence and I sentence them both to death through hanging," he said.

Imran and Norhidayah were charged with Aqeef's murder that took place in an apartment in Bandar Putra, Kulai between midnight on Dec 16, 2013 and 6.45pm on Dec 19, 2013.

The trial began at the Johor Baru High Court in January last year. Thirteen prosecution witnesses were called in, while the defence team called in four witnesses including Imran and Norhidayah.

After the court made its decision, both Norhidayah and Imran were seen in tears. Imran later shook hands with a man believed to be his relative who was seated in the public gallery before they were escorted out of the court room.

State deputy public prosecutor Nor Iffa Zarilah Abdul Rahman prosecuted.

Norhidayah was represented by counsel Shahrudin Osman while Imran was represented by counsel Normah Mohd Desa, who was not present in today's court proceedings.
